In addition to its LHWCA workers’ compensation practice, the firm also has an extensive, national Defense Base Act (“DBA”), practice servicing major DBA insurance providers and carriers throughout the country. The Defense Base Act is a federal workers’ compensation statute that covers workers employed by civilian contractors of the United Stated government. The Act is an outgrowth of the LHWCA and covers both US Citizens and foreign nationals. It is, like the LHWCA, administered by the United States Department of Labor and claims are adjudicated by the federal Office of Administrative Law Judges. The firm’s LHWCA and DBA practice is an international one – with the practice group travelling across the country and internationally to handle cases. The firm serves as panel counsel to the largest Defense Base Act insurance provider in the world and also serves as Defense Base Act counsel to several Fortune 500 companies. The firm provides coverage opinions and has litigated coverage disputes involving the LHWCA and the DBA. The workers’ compensation practice at Freehill is nationally recognized for its expertise, and has served on numerous industry panels and groups, published many articles in the field, and given countless CLE lectures to other lawyers in the areas of DBA and LHWCA compensation practice.
