The firm has an extensive, national federal workers’ compensation practice, having represented some of the largest insurer providers of Longshore and Harbor Workers’ Compensation Act (LHWCA) coverage in the country for the past two decades. The firm has tried over thirty (30) longshore cases and prosecuted numerous appeals successfully in its LHWCA practice. In addition to representing terminals in connection with its longshore practice, the firm also has a specialty in representing various marine construction concerns and shipyards in both federal compensation and “third party” litigation throughout the country. Relevant cases include defeating claims for permanent disability for an injured marine repair worker who suffered a compression fracture, defeating a claim for permanent total disability of a longshoreman who fell down a vessel’s hatch, and defeating a claim for permanent loss of use for an eye injury due to an altercation at a marine terminal. We have also defended numerous claims involving hearing loss and impairment before both State Workers’ Compensation Boards and the U.S. Department of Labor. The firm provides coverage opinions and has litigated coverage disputes involving the LHWCA and the DBA. The workers’ compensation practice at Freehill is nationally recognized for its expertise, and has served on numerous industry panels and groups, published many articles in the field, and given countless CLE lectures to other lawyers in the areas of DBA and LHWCA compensation practice.
